This Privacy Policy discloses the privacy practices utilized by Gistics, Inc., for the web sites that it owns and operates:

Tracking Technology
We do not track your use of our Web Site in any manner whatsoever. In particular, we do not log IP addresses or track your movement within our Web Site, the pages from which you were referred, access times or browser types. We only obtain information about you if you decide to download one of our “White Papers” or other content that we have available for downloading (See: Registration, below), or if you contact us directly with a question, comment or concern. In the future, we may determine to use tracking technologies to improve the services we provide to you. If we do so, we will modify our privacy policy accordingly. See the “Notification of Changes” section below.
Registration
We are in the business of facilitating the execution of breakthrough information technology strategies for our Clients, helping them implement faster, cheaper, and better ways to find and serve their customers. To this end, we offer the public the ability to download copies of the Executive White Papers that we have created for our Clients. We offer this access in an effort to identify potential customers for our Clients’ products or services.
Our White Papers are valuable documents, demonstrating the value proposition represented by our Clients’ products and services or other key technology industry developments. They contain valuable industry information, and most of them retail for $295.00. These White Papers draw upon our extensive research with customer-facing technologies, as today we track more than 10,000 end-use organizations and their deployment of 150 technologies from more than 2,000 vendors.
We provide two ways for individuals to download copies of a particular White Paper. We have paid subscriptions for individuals who opt out of a voluntary information exchange, or free White Papers to qualified executives who opt-in and provide us with relatively detailed personal information about themselves and their companies, such that we can determine whether or not they or their company might be a potential qualified sales lead for one or more of our current or prospective Clients. This information will generally include: information about the person, including name, address, name of employer, type of business, need for certain technological goods or services, the potential time frame in which they may be purchased, and the like.
For those who opt out of our voluntary free registration program yet still desire a copy of a White Paper, it can be obtained for a $295 fee. In such an instance, we will ask the downloader to complete an order form that will request certain specific information, including financial information (such as a credit card number and expiration date) and general contact details, so that we may fulfill the transaction that has been requested. If the order is to be fulfilled by a third party, we may provide such information to the third party for the express purpose of fulfilling the order.
How We Use Personal Information
We use personal information that we obtain from individuals who have voluntarily “opted-in” to receive a free White Paper to provide sales leads to our current and prospective Clients if the personally identifiable information provided indicates that the responder is likely to have a current or relatively near-term need for the featured products or services. We may give this information to our Clients, but in most instances, we sell this personally identifiable information to our Clients.
Our Clients will use the personally identifiable information you provided to present you with other opportunities in accordance with their own privacy policies or otherwise, such as by a direct phone call or a written communication. If you receive an on-line solicitation from one of our Clients, we encourage you to read their privacy statements, as we do not review their privacy policies and are not responsible for their actions.
We also may disclose information about individual users to third parties who agree to provide services to us and who agree to maintain the confidentiality of such information in accordance with this Privacy Policy. These third parties will provide a variety of services to Gistics, including, without limitation, processing and storing user information, helping to create and disseminate new content and promotions for the Web Site, and sending or coordinating the sending of marketing communications that users have consented to receive.
You should also be aware that by submitting personal information to us on this Web Site, you thereby agree that this information may be transferred across national boundaries and may be stored and processed in any of the countries in which we, our affiliates or our Clients maintain offices.
Exceptional Circumstances
Please note that if our business is sold or disposed of as a going concern, whether by merger, sale of assets or otherwise, our customer database could, in whole or in part, be sold as part of that transaction. We also may have to release personally identifying information when it is necessary to comply with judicial or other government subpoenas, warrants or orders.
Security
We believe our Web Site incorporates appropriate safeguards to protect the security, integrity, completeness, accuracy and privacy of the personal information we have collected, and we have put in place reasonable precautions to protect information from loss, misuse and alteration. For example, after we have received your information, we utilize a third party provider who stores and maintains your information by using Secure Socket Layer (SSL) encryption, which is recognized as an industry standard in encryption technology. Our security and privacy policies are periodically reviewed and enhanced as required and only authorized individuals have access to the information you provide us. Although we take appropriate measures to safeguard against unauthorized disclosures of information, we cannot assure you that personally identifiable information that we collect will never be disclosed in a manner that is inconsistent with this Privacy Policy.
Correcting/Updating Personal Information
You have a right to know about the personal information that we may have collected about you. You also have a right to correct or amend such information if it is incorrect. If you wish to exercise these rights, please contact us by post or e-mail at the address shown in the “Contact” section below. However, once you have received the benefit of your bargain by downloading the White Paper for which you exchanged your personally identifiable information, you cannot later seek to have such information deleted.
Terms and Modifications to Privacy Statement
By using our Web Site, you signify your agreement to the terms of our Privacy Policy. If you do not agree with these terms, you should not use the Gistics Web Site.
